Terms of Service & Disclaimer

1. Acceptance
By accessing or using BombPot (the “Service”), you agree to these Terms. If you do not agree, do not use the Service.
2. Play-money only; not gambling
The Service uses virtual “chips” for entertainment only. Chips have no real-world or monetary value, are not for sale, cannot be redeemed, exchanged, or cashed out, and do not represent currency. The Service does not process, hold, transfer, or facilitate any payment, deposit, wager, or payout of real money. The optional chip ledger is a record-keeping and arithmetic tool for play chips only and is agnostic as to whether chips represent anything.
3. Your responsibility & local law
You are solely responsible for your own conduct and for complying with all laws that apply to you. If you choose to associate real money or anything of value with play chips, or to settle up off the platform, you do so entirely at your own risk and on your own arrangements. Any such arrangement is strictly between you and the other players; BombPot is not a party to it, does not endorse it, and bears no responsibility for it. Online and real-money gambling are regulated or prohibited in many places — it is your responsibility to know and follow the laws of your jurisdiction.
4. Eligibility
You must be at least 18 years old (or the age of majority where you live) to use the Service, and you represent that you are.
5. Acceptable use
You agree not to use the Service for any unlawful purpose; not to use it to operate or facilitate real-money gambling where prohibited; and not to cheat, exploit, reverse-engineer, disrupt, or attempt to gain unauthorized access to the Service or other users’ information.
6. No warranty
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AVAILABILITY, ACCURACY, OR NON-INFRINGEMENT. We do not guarantee that the Service will be uninterrupted, error-free, secure, or that game state, chip counts, or shuffles will always be correct or preserved.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL HOMEGAME, ITS OPERATOR, OR ITS CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY. BECAUSE THE SERVICE IS FREE, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
8. Indemnification
You agree to indemnify and hold harmless BombPot and its operator from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or any dispute between you and another user, including any real-world stakes or settlements you arrange.
9. Disputes between users
BombPot is not responsible for, and will not mediate, any dispute between players, including disputes over off-platform settlements.
10. Privacy
The Service collects only what is needed to run a game: a display name you choose and gameplay actions. It does not require or process real names, payment information, or sensitive personal data. Session information may be stored in your browser (local storage) so you can rejoin a table. Game state is held in memory and is not guaranteed to be retained.
11. Termination & changes
We may suspend or terminate access at any time, and may update these Terms. Continued use after changes means you accept the updated Terms.
12. Governing law & venue
These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-laws rules. You agree that any dispute relating to the Service or these Terms will be brought exclusively in the state or federal courts located in New York County (Manhattan), New York, and you consent to their jurisdiction. If any provision is found unenforceable, the remaining provisions stay in effect.
